Can AI Have Personal Rights?

Abstract:

 Can artificial intelligence have personal rights? Is it possible to infringe the personal rights of artificial intelligence? Legal doctrine has not posed such a question so far. The reason is, perhaps, the lack of practical need - in the current state of technological development, artificial intelligence is not yet sufficiently advanced. However, the development of artificial intelligence is extremely dynamic, so we should expect that reality will soon force us to ask and therefore to answer the question of whether artificial intelligence can have personal rights. It is also worth noting that the answer to the above question also speaks to the axiological justification of the institution of personal rights because a prerequisite for formulating this answer is to decide and to justify what conditions must be met for artificial intelligence to be “the disposer” of personal rights.
