Abstract:
The constitutional economy is an interdisciplinary scientific knowledge of how constitutional norms and principles should form and shape the economic policy of the state, the adoption of the most important economic decisions. The economic basis of any state, regardless of its form, is based on property relations. The article explores the goals, objectives, main directions and problems of the development of the constitutional economy in modern Russia. The authors study the role of the constitutional and judicial doctrine in ensuring stability and development of the constitutional economy. The problematic issues, the solution of which is necessary for the stable development of economic relations, are identified. The necessity of attracting the institutions of civil society for the development of a constitutionally sound state economic policy is substantiated. The analysis of the legal positions of the Constitutional Court of the Russian Federation on the normative consolidation of property relations and ensuring the protection of the right of private property from the actions of public authorities is carried out. A number of contradictions and trends in constitutional judicial practice, which have a negative role in the development of the constitutional economy in general and property relations in particular, are revealed.
