Abstract:

Mediation has acquired legal foundations in the Russian Federation since 2010. Use of mediation is possible both in resolving labor and family disagreements. But its use only by specialists with a legal education significantly limits the scope of this method. The psychological mechanism of triangulation exists in different types of relationships between adults. The use of mediators in conflicts changes the situation, it can reduce tension in relationships and helps to reach agreement, as well as resolve the conflict. The authors conducted a pilot study of the state of information awareness of the working population in the field of mediation, readiness for mediation and attitude to this procedure. The study employed a survey and analysis of published registries. The study showed that the procedure is currently not fully used; the main users of mediation are lawyers. The use of mediation by psychologists is implemented mainly in schools or registry offices to resolve school or family conflicts at the stage of divorce. Mediation in the regulation of labor relations has prospects, but is used to a small extent. The results of the study can be used both in searching for the reasons of the difficulties in introducing mediation, and in the possibilities of mediation from a legal, psychological, cultural point of view, as well as for educational purposes to reflect on the development directions of society in the field of mediation and conflict resolution.
