Abstract:

The article is devoted to one of the most pressing problems in the field of criminal liability for illegal impact on the critical information infrastructure of the Russian Federation - determination of estimated signs of illegal impact on the critical information infrastructure of the Russian Federation. The relevance of the selected topic is dictated both by strategic priorities and official views of state authorities in the field of national security in the information sphere. Together with the trend of large-scale proliferation of computer crimes, issues related to criminal liability under the offences provided for in Chapter 28 of the Criminal Code of the Russian Federation, including under Article 274.1 of the Criminal Code, are of particular importance. Given the increased public danger of encroaching on the critical information infrastructure of the Russian Federation. Modern problems of legislative formulation of certain characteristics of the crime provided for in article 274.1 of the Criminal Code of the Russian Federation have been identified. Legislative initiatives have been proposed in the field of determining the evaluation characteristics of the offence provided for in article 274.1 of the Criminal Code of the Russian Federation, which are necessary in the absence of established law enforcement practice.
