Implementation of Electronic Document Management at the Stage of Crime Report Reviewing as a Factor in Ensuring Criminal Procedure Effectiveness

Abstract:

Prospects for the implementation of electronic document management in criminal procedure implementation at the stage of criminal case initiation are described in the article. Proposals to consolidate procedural capabilities of submitting and registering crime reports online are formulated. Creating, issuing and using electronic documents as court review materials are also described. The main attention is paid to theoretical aspects and practical applicability of modern computerization mechanisms for relations arising at the stage of criminal proceedings initiation. The study of foreign experience in legal regulation of electronic document management in criminal proceedings allows to enrich domestic regulatory system with current and effective developments, contributes to strengthening of legal means of individual rights ensuring. The author describes possible procedure of received crime reports in electronic form, analyzes advantages and positive changes that can happen due to digitalizing at the initial stage of criminal proceedings: the use of electronic documents and electronic signatures on documents will significantly speed up documents flow, simplify evidence collecting procedure and reduce time costs in legal proceedings. The limitations to be overcome in informational improvement at the stage of criminal proceedings initiation are described. It is advisable to make a list of procedural documents that can be compiled and signed in electronic form at the stage of criminal proceedings initiation, as well as to regulate the procedure for their document circulation. It should be done as a part of initial changes towards the reform of pre-trial proceedings and the creation of a regulatory platform for conducting so-called electronic criminal case in the future.
