Insurance Fraud as an International Problem: A Comparative Legal Analysis of Russian and Foreign Legislation

Abstract:

In this article, the authors focus on the disclosure of the concept of fraud in the insurance sector in domestic legal science and abroad. The article highlights the practical aspects of the criminal activities of a fraudulent insurer based on international experience in the insurance industry. The authors consider various forms of such fraud, both by policyholders and by insurers. Analysis of foreign experience in combating insurance fraud allows, on their basis, to formulate recommendations for the regulation of the Russian insurance market in order to counter insurance fraud. The authors cite statistical data from international organizations whose activities are aimed at countering the negative phenomenon under consideration, which allow us to summarize that such an appeal for experience to foreign countries is useful and expedient for Russian society. The authors came to the conclusion that due to the urgency of the problem of criminalizing fraud in the insurance industry, which in Russia is given a less significant place at the legislative level than in foreign countries, an important direction in the activities of the domestic legislator is the appeal to international experience in the fight against insurance fraud. This can provide an excellent basis for improving insurance fraud legislation.
