Limitation of the Freedom of Economic Activity under the Rulings of the Constitutional Tribunal of the Republic of Poland

Abstract:

The concept of "economic freedom" is an ambiguous term used by lawyers, economists, political scientists, and historians of political and legal thought. In the works of economists and political scientists, "economic freedom" is generally not defined. However, the literature emphasizes the lack of methodological reflection on the modality of using the term "economic freedom." This term is important because it appears in several scientific disciplines that use different instruments to describe reality and because its understanding by the public authorities has a significant impact on the creation of economic reality.
