Abstract:
The problem of influence of local councils, local state administrations, deputies of all levels and heads of territorial communities on the processes of decentralization of public power in Ukraine is considered. The process of decentralization in the territory of Poltava region of Ukraine is taken for a model for positioning these processes. The authors consider peculiarities of influencing the unification processes of the judiciary by submitting applications from opponents of decentralization. Ways to improve the current legislation concerning the consolidation of institutions of "united territorial community" and "head of community", legal control over holding public hearings of the community are proposed.
The article reveals the urgency of changes in the system of public authority, which would enhance its effectiveness. Examples are given of several government attempts to implement them, but often these efforts encounter misunderstandings by both the public sector (the population itself) and governmental and local management teams. Successful implementation of any kind of reform is essential: political will of authorities; existence of program of reform that is understandable for all; positive public opinion formed by the authorities; a team of like-minded reformers from the center to each district; time for positive evaluation of reforms before the next election and necessary resources and funds. Very often, most of these components were either missing or insufficient at certain stages of state formation. The article outlines some mechanisms of administrative resistance to decentralization reform in Ukraine.
