Abstract:
Mediation is a process in which an impartial and independent third party facilitates communication and negotiation and promotes voluntary decision making by the parties to a dispute to assist them to reach a mutually acceptable solution.
The main purpose of this article is to discuss mediation as an alternative dispute resolution (ADR) mechanism so that, at the very least, an individual, a corporation, or any other entity which finds itself on either side of a dispute will be familiar with the concept and the procedures involved.
It is also of a great importance to analyze the regulations that govern this domain in order to underline the growing importance of this alternative dispute resolution method at European level. By knowing the mechanisms, the tendencies in this field will help the companies improve their management.
