Abstract:
The commercial insurance company is an entity, which on the basis of an insurance policy provides insurance protection and stabilizes thus a standard of living or an economic level of a client party or an injured party. In recent years, especially the client protection has been emphasized within the insurance relationship. The reason consists in certain information asymmetry and also generally in a weaker client's position in relation to the insurer. The question is, whether the insurer also needs to get a certain level of protection within the insurance relationship. Insurance conditions confirm this proposition; it is possible to find there several options or tools that disallow a beneficiary to obtain insurance benefit (fully or partially) and protect the insurer that way. This paper deals with protection options of a commercial insurance company within the insurance relationship. The aim of this paper is to define these options, to carry out their systematization and to reflect on their importance. The paper contains only a theoretical part and it should be perceived as a philosophic introduction to this issue. The methods of analysis, deduction and synthesis will be used in the paper.
