Smart Regulation and Regulatory Impact Assessment: A Case from Italy Case

Abstract:

Our paper deals with the regulatory impact assessment (RIA) and put it into the context of efficient ex-ante and ex-post analytical tool securing more efficient legislative process. The paper analyzes the beginning of RIA, its development and also strengths and weaknesses from the perspective of Italy, where the implementation of legislation after ex-ante impact analysis has got a strong tradition. The paper concludes RIA does not automatically secure a high-quality legislation, because stakeholders tend to modify the process according to their needs; for example, when proponents of the law do also the RIA reviewing procedure. The basic condition for well-functioning RIA process is the while legislative system, where RIA is just one important element.
