Abstract:
Confidentiality is one of the basic duties of a medical practice. It requires medical professionals to maintain the confidentiality of patient health data in the context of the medical services provided to them. It is worth noting that during the provision of health services patient are sharing their personal and discretional informations with health care professionals. Therefore, the category of confidentiality requires special attention and respect, as it is the foundation of the entire system of medical discretion, the problem of trust in interpersonal relations, especially those relating to the doctor-patient relationship. All these elements correlate with human rights, in particular with the right to the protection of private life and the autonomy of the individual (Dworkin 1988, 2015). In the following Article, we will relate the issue of confidentiality to the institution of medical secrecy understood as respect for the privacy and autonomy of the patient, which is a challenge for the modern health industry and the medical law system.
