Abstract:
This paper aims at researching the impact of information and communication technology on the development of the criminal justice system, as part of research into the legal model in an information society. The methodological approaches are based on the sociological method, the comparative law methodological research, as well as formal logic and systematic juridical methods, etc. The scientific and practical value of the research is related to considering the technological innovation as just one of the factors driving changes in criminal-procedure context and the emergence of new statutory forms in criminal justice. The advantages of integrating the criminal proceedings into the unique cyberspace were shown. This paper’s major findings are that in the Russian Federation, one may view as a significant step toward the creation of legal cyberspace the changes that are being made to the activity of law-enforcement agencies, courts in particular. Presently, there are a number of difficulties with the practical implementation of the information society model in the legal system. This paper makes some proposals to ensure the effectiveness of electronic means in the context of both criminal procedure and the protection of criminal justice parties’ legal rights and interests.
