Abstract:
Entrepreneurship has begun to develop alongside with the development of civilization. Nowadays different countries and cultures perceive it differently. From economics perspective, entrepreneurship is the main tool for economic development of each state. The main issue before starting the business is to determine suitable legal form of business. Ideal legal form of business, especially in area of family business, is public company with origin in German and Austrian Business Law. Although this legal form has its benefits, it is not common to use it in Slovakia. Also, business law theoreticians give it little space in their research. The intention of the authors is to provide a coherent view through scientific and doctrinal interpretation. By using professional literature, jurisprudence, and legislation, we will review the legal regulations of a public company and confirm or reject the hypothesis that a public company is an unnecessary type of business and a historical experience of business law. This document is primarily oriented on Business Law with some intersections to economics and management. In this document we can also find multidisciplinary and international features of exploring this issue, which concept and regulation remains in Slovak legal environment still not finished even after years of professional and laic discussions.
