The Role of Mediation in Dispute Resolution in Business Relations

Abstract:

The aim of this article is to identify the role of mediation in dispute resolution in business relations. The considerations presented are of a theoretical and discursive nature. The article employs critical analysis as a research approach. The discussion was conducted with a view to formulating answers to the research questions posed. The first of these concerned the impact of mediation on the effective resolution of conflicts between business partners. The second question, however, focused on the factors influencing this process. The article attempts to elaborate on selected characteristics of business disputes and mediation. Based on the considerations presented, it was concluded that, in practice, the use of the analysed method corresponds to an understanding of business conduct that fosters dialogue. The achievement of consensus among the parties involved in mediation may contribute to continued cooperation and the acquisition of new skills useful in future business ventures.
