The Security of Personal Data during Cross-Border Transmission in the Integrated Information System of the EAEU in the Context of the Digitalization of the Economy

Abstract:

The current stage of development of society is characterized by an increasing role in the field of information. Currently, technical means allow for the collection and processing of significant amounts of socially significant data necessary for the effective functioning of state mechanisms, the flow of public processes, and the implementation of human rights. Increasing the vulnerability of people's private lives and creating threats to illicit trafficking in personal data is facilitated by the intensive development of automated technologies in the field of information processing and transmission, their introduction into all social spheres of society. Proper legal regulation of this process should maintain a balance of interests of participants in information turnover and to some extent compensate for the increase in the effectiveness of modern technologies used in cross-border transfer of personal data.

For both Russian and foreign legislation and legal doctrine, the task of legal protection of personal information becomes particularly relevant in the context of active development of open information systems that significantly simplify the leakage and other forms of illegal use of personal data.

In this article, we consider the legislation on personal data of the member States of the Eurasian economic Union in terms of personal data security during cross-border transmission in the integrated information system of the EAEU. Problems related to the comprehensive state approach of the EAEU member States in the field of protection of the rights of personal data subjects are identified.
