Abstract:

The author carried out the analysis of the historical and standard legal materials in the sphere of the enterprise law. As a result of the conducted research the author came to a conclusion that the conceptual framework of the enterprise law is not fully designated in the domestic jurisprudence. Today the common and integral system of the used concepts of the sphere of business did not develop yet. As it is well-known many theoretical mistakes happen just because of the inability to handle the initial conceptual material therefore the logical borders of legal concepts are broken and the conceptual and semantic meanings of terms are mixed up and etc. The author of the article paid due attention to the analysis of the conceptual framework developed at the beginning of the 20th century and proved its actuality and prospects in its use. Within the scientific article it has been considered the reasons and conditions of the origin of a concept of the enterprise law and it is comprehensively analysed the substance of the concept of the enterprise law. Also the author places emphasis on those values which it has in the theory of the enterprise law, jurisprudence, and law-enforcement activity. Studying of a perspective of forming the conceptual framework allowed the author of the article to define the existence of several different types of the concepts used for the description of businessmen that in turn gave the chance to allocate six certain "layers" on which the concepts of the enterprise law sphere can be spread out.
