Trade Union’s Control as a Form of Public Control in the Russian Federation

Abstract:

Russian legislation on trade unions establishes their right to exercise public control. In turn, the Federal Law "On the Basics of Public Control in the Russian Federation" does not call trade unions as a subject of public control. Proceeding from the foregoing, there is a legal conflict that leads to the allocation of trade unions of the public controller’s functions and at the same time excludes them from the number of entities entitled to exercise such control. The author proposes a solution to this conflict, by introducing amendments to the Federal Law "On the Basics of Public Control in the Russian Federation" with respect to the expansion of the list of public controllers.
